1. Agreement to these Terms
These Terms of Service govern access to Kestrel’s websites, member workspace, research records, planning tools, opportunity listings, communications, subscriptions, and optional community access. By creating an account, joining a trial or waitlist, paying for a plan, connecting Discord, or otherwise using Kestrel, you agree to these Terms and the policies linked from them.
If you do not agree, do not use Kestrel. If you use Kestrel for an organization, you represent that you have authority to bind that organization.
2. Who we are
Kestrel is a Mansa Merch LLC initiative. It is a digital research, planning, work-opportunity, communications, and community-access platform designed to help adults build portable education, work, relocation, and business routes.
3. Eligibility and account responsibility
- You must be at least 18 years old to create an account or enter Kestrel community spaces.
- You must provide accurate account and billing information and keep it current.
- You are responsible for your credentials, devices, account activity, and anyone you authorize to use your account.
- You may not use Kestrel where doing so would violate applicable law or sanctions restrictions.
- Tell us promptly if you believe your account or connected service has been compromised.
4. What Kestrel may provide
Features may vary by plan, launch phase, region, provider availability, usage limits, payment status, and product configuration.
- education and program research, comparisons, source records, calendars, and progress planning
- remote-work listings, location-policy context, employer records, and application tracking
- country, city, visa-route, cost, housing, healthcare, and relocation research
- budgets, runway scenarios, checklists, deadlines, saved resources, and personal roadmaps
- official Kestrel messages and optional Discord community access
- paid membership features, workshops, office hours, and early-product feedback access
5. What Kestrel is not
Kestrel is not a university, school, accreditor, admissions office, scholarship provider, lender, employer, recruiter, immigration service, relocation agency, housing broker, travel agency, law firm, tax adviser, investment adviser, insurance broker, healthcare provider, or government authority.
Kestrel content and workflows are organizational support. They are not legal, immigration, tax, financial, academic, employment, medical, safety, or other professional advice.
6. No outcome guarantees
- Kestrel does not guarantee admission, credit transfer, accreditation, financial aid, scholarships, employment, interviews, work authorization, visas, residency, housing, insurance, income, savings, safety, or any particular outcome.
- A “location-compatible” role means the available policy information appears compatible with stated geography or time-zone criteria. It is not a work-authorization, payroll, tax, or employment guarantee.
- Budgets, costs, timelines, eligibility notes, and scenarios are estimates for planning and may change.
7. Sources, reviews, and changing information
Kestrel may record source URLs, review dates, policy history, caveats, and confidence notes. This evidence trail helps you understand where information came from; it does not make the information infallible or permanently current.
Schools, employers, governments, carriers, landlords, insurers, and other third parties may change requirements without notice. Before acting or paying, confirm final requirements directly with the responsible institution, authority, provider, or qualified professional.
8. Automated and assisted features
When Kestrel offers automated summaries, comparisons, recommendations, or drafting assistance, those outputs may be incomplete or incorrect. They are starting points for human review, not autonomous decisions or professional determinations.
You remain responsible for reviewing outputs, checking source material, and deciding whether information is suitable for your circumstances.
9. Plans, billing, cancellation, and refunds
- Paid plans renew at the billing interval shown at checkout until canceled.
- You authorize the payment provider to charge the displayed recurring amount, taxes, and any clearly accepted add-ons.
- You may cancel before the next renewal. Paid access remains available through the end of the paid period unless access is suspended for a policy violation or charge reversal.
- Fees are nonrefundable except where required by law or where a written offer expressly says otherwise.
- We may change future pricing or plan contents with advance notice where required. Price changes do not apply retroactively to a completed billing period.
10. Founding access is membership, not ownership
“Founding,” “founding member,” and similar language describe early paid membership and recognition. They do not grant stock, equity, profit sharing, voting rights, governance authority, employment, partnership, or ownership in Kestrel or Mansa Merch LLC.
Founding pricing is limited to the configured member count and remains available only while the qualifying subscription stays continuously active. Cancellation, failed payment, refund, chargeback, or loss of eligibility may end founding pricing.
11. Discord and community access
Discord is optional. Research, planning, saved data, membership, billing, and official records remain in Kestrel. Community discussion, fellowship, accountability, and some events may occur in the Kestrel Discord community.
Discord access is also governed by Discord’s own terms and policies. Kestrel may assign, change, or remove roles based on Kestrel membership, payment, safety, and policy status.
- Discord direct messages and private voice conversations are not continuously monitored by Kestrel.
- Do not treat another member’s presence, role, or message as identity verification or endorsement.
- Report suspicious conduct in Kestrel-controlled spaces through the published reporting channel.
12. Private and offline interactions
Kestrel does not supervise, verify, endorse, arrange, or control private conversations, transactions, travel, housing arrangements, employment arrangements, romantic relationships, business deals, or in-person meetings between members. These activities are voluntary and at your own risk.
Kestrel is not a party to private member agreements and does not guarantee another member’s identity, honesty, qualifications, intentions, or safety. Review the separate Offline Interaction and Safety Policy before meeting, traveling, paying, or sharing sensitive information.
13. Your content and permissions
You retain ownership of content you submit to Kestrel. You give Kestrel a limited, nonexclusive permission to host, copy, process, display, and transmit that content only as reasonably necessary to operate, secure, support, and improve the service or comply with law.
You must have the right to upload or share content and must not submit material that violates another person’s privacy, confidentiality, intellectual property, or legal rights.
14. Acceptable use
- Do not harass, threaten, stalk, impersonate, dox, exploit, discriminate against, or defraud another person.
- Do not post scams, deceptive opportunities, unlawful offers, malware, spam, or content intended to bypass safety or payment controls.
- Do not scrape, reverse engineer, probe, disrupt, overload, or gain unauthorized access to Kestrel or another account.
- Do not use Kestrel to violate employment, immigration, housing, education, privacy, communications, export-control, sanctions, or other applicable laws.
- Do not resell nonpublic Kestrel research, member data, or access without written permission.
14A. Kestrel Line communications service
Kestrel Line is an optional paid communications add-on that may provide an assigned U.S. telephone number, browser calling, messaging, voicemail, contacts, and related usage tools. Availability depends on your plan, payment state, identity review, messaging registration, provider coverage, technical readiness, and applicable law.
Kestrel Line is not a mobile carrier replacement, emergency service, anonymous communications service, bulk-messaging platform, call-recording product, or guarantee that a particular number, area code, channel, destination, or provider feature will remain available.
- Kestrel Line cannot call 911 or other emergency services; keep access to a local emergency-capable phone.
- You must follow the Kestrel Line Acceptable Use Policy, respect consent and opt-out requests, and use accurate identity and billing information.
- Included voice and messaging allowances are prepaid limits. Service may pause at the limit; Kestrel does not automatically create an overage balance.
- Telephone numbers remain controlled by the relevant provider and may be changed, suspended, reclaimed, or released for nonpayment, inactivity, legal requirements, provider changes, fraud, abuse, or account closure.
- Call recording is not supported. Voicemail and message media are user communications content and are subject to the Privacy Policy and retention controls.
15. Third-party services and links
Kestrel may rely on third parties for hosting, authentication, storage, payments, communications, maps, analytics, and optional Discord access. Third-party services operate under their own terms and privacy practices, and their availability may affect Kestrel features.
A link, listing, or integration does not mean Kestrel endorses or guarantees the third party, its content, or its services.
16. Kestrel intellectual property
Kestrel’s software, design, brand assets, original research structure, interfaces, documentation, and service content are owned by Mansa Merch LLC or its licensors and are protected by applicable intellectual-property laws.
These Terms give you a limited, revocable, nontransferable right to use Kestrel for its intended personal or authorized business purpose. They do not transfer ownership.
17. Availability and product changes
Kestrel is provided on an as-available basis. We may add, change, pause, limit, or discontinue features for security, legal, provider, maintenance, or product reasons. We do not promise uninterrupted, error-free, or permanently available service.
18. Suspension, termination, and data export
We may restrict or terminate access for material policy violations, harmful or illegal conduct, fraud, security risk, nonpayment, abuse of providers, or legal requirements. When practical and legally permitted, we will provide notice and a reasonable opportunity to address the issue.
You may stop using Kestrel at any time. Export and deletion requests are handled under the Privacy Policy, subject to identity verification, technical limits, legal holds, fraud prevention, and records we must retain.
19. Warranty disclaimer
To the fullest extent permitted by law, Kestrel is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, security, or uninterrupted availability.
20. Limitation of liability
To the fullest extent permitted by law, Mansa Merch LLC and its affiliates, officers, employees, contractors, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or savings; or losses arising from third-party decisions, travel, housing, work, education, immigration, community interactions, or reliance on changing information.
Where liability cannot be excluded, the aggregate liability arising from Kestrel will not exceed the greater of the amount you paid to Kestrel during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. This limit does not apply where prohibited by law or to liability caused by gross negligence, willful misconduct, or other liability that cannot legally be limited.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mansa Merch LLC and its affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of Kestrel, your content, your private transactions or interactions, or your violation of these Terms or another person’s rights.
22. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless a separate written agreement says otherwise, disputes will be handled in state or federal courts located in California. Nothing in these Terms removes nonwaivable consumer rights available under applicable law.
23. Changes and contact
We may update these Terms to reflect product, provider, operational, or legal changes. We will update the date above and provide additional notice for material changes where appropriate. Continued use after updated Terms take effect means you accept them.
